Acceptance of Terms

1.1. Agreement: These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and FundBit (referred to as “FundBit,” “we,” “us,” or “our”).

1.2. Eligibility: By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. Our Services are not intended for individuals under the age of 18.

1.3. Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the “Effective Date” at the top. We may also notify you via email or through prominent notices within the app prior to the change becoming effective. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

FundBit Services

FundBit provides a platform that allows users to:

• Buy and sell cryptocurrencies

• Conduct bill payments (e.g., mobile airtime, internet data, electricity, cable TV)

• Purchase gift cards

• Engage in Peer-to-Peer (P2P) trading

• Perform coin swaps

• Access other related financial technology services as they may be introduced from time to time

User Accounts

3.1. Account Registration: You must register for a FundBit account. Provide accurate, current, and complete information and keep it updated.

3.2. KYC/AML Compliance: As a regulated platform, FundBit collects personal details during registration and use, including full name, email, phone number, date of birth, and government-issued ID (e.g., NIN, BVN). Accounts may be limited or suspended for non-compliance or inaccurate data.

3.3. Account Security: You are responsible for your login credentials and all activity under your account. Notify FundBit immediately of any unauthorized access. We are not liable for loss or damage due to your failure to secure your account.

Transactions and Fees

4.1. Transaction Authorization: Transactions from your account are considered authorized and final unless stated otherwise.

4.2. Accuracy of Information: You are responsible for verifying all transaction details.

4.3. Fees: Fees for services are shown before confirmation. By proceeding, you agree to the fees. FundBit may update fees with notice.

4.4. Fiat and Cryptocurrency Holdings: Your funds are held for transaction facilitation only. FundBit is not a bank and funds are not insured.

Prohibited Conduct and Restricted Activities

5.1. You may not use the Services for:

• Illegal activities

• Fraud

• Money laundering or terrorist financing

• Market manipulation

• Unauthorized access

• Spreading malware

• Harassment

• Intellectual property infringement

• Circumventing FundBit’s controls

• Access from restricted countries

5.2. Suspension and Termination: FundBit may suspend or terminate accounts at our sole discretion to protect the platform or comply with legal obligations.

Intellectual Property

All content and intellectual property on FundBit’s platform are owned by FundBit or licensed to us. Do not use without written permission.

Disclaimers and Limitation of Liability

7.1. No Financial Advice: FundBit does not provide investment or legal advice. Information is general and for informational purposes only.

7.2. Risk of Cryptocurrencies: Crypto markets are volatile. You accept all investment risks.

7.3. Service Availability: We do not guarantee uptime. Services may be unavailable due to maintenance or issues.

7.4. “AS IS” Basis: Services are provided without warranties of any kind.

7.5. Limitation of Liability: FundBit is not liable for any indirect, incidental, or consequential damages related to your use of the Services.

Indemnification

You agree to indemnify and hold harmless FundBit and affiliates from claims arising out of:

• Your use of the Services

• Your breach of these Terms

• Your infringement of third-party rights

• Unauthorized use of your account

Data Privacy

Your data is handled according to our Privacy Policy. By using the Services, you agree to these practices.

Governing Law and Dispute Resolution

10.1. Governing Law: Governed by the laws of the Federal Republic of Nigeria.

10.2. Dispute Resolution: Disputes shall be resolved by arbitration in Abuja, Nigeria, under the Arbitration and Conciliation Act. Language: English.

Miscellaneous

11.1. Entire Agreement: These Terms and the Privacy Policy are the full agreement.

11.2. Severability: Invalid provisions do not affect the remainder.

11.3. Waiver: No waiver unless in writing. Failure to enforce is not a waiver.

11.4. Assignment: You may not transfer your rights. FundBit may assign its rights and obligations.
